Karen R. Morgan

Karen is Senior Counsel with Kuchler Polk Weiner and brings over 20 years of civil litigation experience to the firm. She practices in state and federal courts representing both plaintiffs and defendants and focuses on employment, securities, and unfair competition disputes. Karen graduated from Indiana University in 1989 with a Bachelor of Arts degree in English.  In 1992, Karen earned her Juris Doctor from Louisiana State University.

Although Karen was born and raised in New Orleans, she began her practice of law in Chicago working for Cook County representing abused and neglected children. In 1999, she moved to Texas where she started her career in civil litigation in the areas of insurance defense and energy law during which time she played a key role in products liability cases, environmental matters as well as insurance disputes. No matter the area of law, Karen approaches her litigation practice with the dedication and focus necessary to obtain her clients’ goals.

EMPLOYMENT LITIGATION
  • On team representing employer in Fair Labor Standards Act case.
  • Representing various clients in non-competition and non-solicitation matters.
ENERGY LITIGATION
  • On team that represented insurer in multi-million dollar Texas state court subrogation case against a company owned by a Fortune 100 company involving complicated defective frac valve assembly.
  • Key member of team that represented oil and gas exploration company and its insurer in joint subrogation case involving pollution and remediation issues arising out of plugging and abandonment activities.
  • Member of team that represented oil and gas exploration and development companies and their insurers in Louisiana state court subrogation case against one of the world’s largest steel producers involving products liability.
  • Developed and briefed critical legal analysis on behalf of insureds and insurers in subrogation case against oilfield equipment manufacturers involving defective blowout preventer resulting in a settlement over $10 million.
  • Key member of team that obtained multi-million dollar recovery for insurer in Louisiana subrogation case involving negligence and breach of contract arising from drilling supervisor’s failure to control well blowout.
  • Developed and drafted successful summary judgment on bad faith claims in Louisiana federal court case involving “underground control of well endorsement,” and assisted in negotiating favorable settlement of contract claims.
  • Part of trial team that defended insurer in Louisiana state court case involving “due diligence” provision in energy package policy resulting in favorable settlement on eve of trial.
  • Developed and briefed complicated legal issues related to bankruptcy and fraud on behalf of insurers in a first-party claim for downhole equipment losses in well blowout incident.
