Partner Janika Polk recognized as the Louis A. Martinet Legal Society “Member of the Month.”

Kuchler Polk Weiner is pleased to announce that founding partner Janika Polk was recognized as the Louis A. Martinet Legal Society “Member of the Month.” The New Orleans Chapter of the Louis A. Martinet Legal Society, Inc. was “established to encourage the interchange of ideas, promote legal scholarship, advance the science of jurisprudence, promote the administration of justice, uphold the order and ethics of the courts and the profession of law and promote the welfare of the legal profession in Louisiana.”

The Louis A Martinet Legal Society’s spotlight on Janika recognizes her commitment to diversity in the legal profession as well as a recent trial victory. Janika Polk, Lee Ziffer and Deb Kuchler recently ran into Dale Earnhardt, Jr. at Hendrick Motorsports where Freightliner is prominent. We’re reminded of how important it is as outside counsel to learn the client’s business.

What’s important to each client?

That’s why, on our own time and on our own nickel, we:

  • Visit the client’s operation;

  • Climb on and drive a tractor;

  • Pick up a power tool and disassemble a brake drum;

  • Swing on a personnel basket onto an oil rig;

  • Don a Tyvek suit, hard hat, goggles, ear protectors and steel-toed boots for an inspection of a chemical plant or refinery;

  • Dive into the science underlying a product liability case;

  • Learn the lingo of deepwater drilling;

  • Know how to get to the port side from starboard on a client’s vessel; and

  • Understand the sensitivities involved in the client’s environmental stewardship issues.

We are 100% in it with our clients.  When they have skin in the game, so do we.

Opinion Obtained by the LA 4th Cir. Court of Appeals Reversing Orleans Verdict

On May 18, 2012, Janika Polk and Lee Ziffer obtained an opinion from the Louisiana Fourth Circuit Court of Appeal reversing an Orleans Parish trial judge’s ruling quashing our client’s subpoena to the Johns Manville Asbestos Settlement Trust. In what is the first Louisiana appellate opinion on the matter, the Fourth Circuit found that contrary to the plaintiff’s arguments and the trial court’s determination, defendants are entitled to discover a plaintiff’s submissions to an asbestos bankruptcy trust and that those submissions are not protected by any recognized privilege under Louisiana law.
