Recently, in Wright v. ANR Pipeline Company, 2016 WL 3268733 (5th Cir. 6/14/2016) the Fifth Circuit affirmed the trial court’s dismissal of an ANR employee, whom the defendants (all of whom were represented by Kuchler Polk) claimed was improperly joined to defeat federal diversity jurisdiction. This decision was significant because the trial court had dismissed the claims of numerous plaintiffs on the merits after they could not meet their burden to show their claimed injuries were caused by the emergency shutdown at the ANR natural gas compressor station. Rather than appealing the dismissal on the merits, the plaintiffs chose to challenge the trial court’s jurisdiction and lost.
